This is the often the most emotionally stressful time in any family law case where both legal custody and physical custody is established. Legal custody establishes which parent retains the right to make the educational, medical and religious decisions of the children. Physical custody is the time the child or children reside with the parent. We have extensive experience in handling a wide range of custody and visitation arrangements. The best interests of the children is the focus in this portion of your case. Although sole custody can be granted when it is in the best interest of the child, it is no longer assumed that one parent shall automatically have sole custody or primary custody of the child or children, and the other has a limited amount of time with them. Rather, all custody decisions start out in favor of some form of joint custody and a visitation plan that is best for your children is established.
